Probate is the legal process by which a person's property is distributed to beneficiaries upon death. Attorney Jennifer Byrom has more than 23 years of experience guiding families through the probate process in Santa Rosa County, Escambia County, Okaloosa County and Walton County in the Florida panhandle.
How assets are distributed will be determined by the decedent's last will and testament. If there was no will, Florida's laws of intestate succession will determine how assets are distributed.
There are three main types of probate in Florida:
- Formal administration for estates valued at greater than $75,000. In a formal probate administration, the court will appoint a personal representative to gather, value and distribute the decedent's assets to beneficiaries.
- Summary administration, which is an abbreviated form of probate for estates valued at less than $75,000. In summary administration, assets can be distributed directly by the court without the need for a personal representative.

Ancillary administration, which is used to distribute Florida real estate such as a condo or winter home when the primary probate proceeding is conducted in another state.
Attorney Jennifer Byrom will guide the personal representative and other family members through the Florida probate process. She will also do a final accounting of the estate, unless waived by all beneficiaries. Any federal taxation issues will be handled by a certified public accountant.
Before any Florida property can go through the probate process, you will need a certified copy of death certificate for the deceased person, as well as the original will if there is one.
